1. PROPERTY. The property is located at: 233 SALEM RD. POUND RIDGE, NY 10576. The property is fully furnished and includes bedding, bath linen and kitchen equipment. 2. SECURITY DEPOSIT. The security deposit shall be released per Airbnb terms within 14 days of the Checkout Date provided no deductions are made due to: • Damage to the property or furnishings • Any violation of the house rules • Dirt or other mess requiring excessive cleaning • Any other cost incurred by Homeowner due to Guest's stay • PLEASE report any property defects or issues discovered at check-in to homeowner immediately 3. MAXIMUM OCCUPANCY: The maximum number of overnight guests is limited to 7 adults (plus infants under 2) OR 5 adults and 2 children. ***IMPORTANT*** ONLY THOSE PERSONS LISTED IN THE RENTAL PARTY BELOW may occupy the property at any time - any additional occupants/visitors MUST be approved by the owner. 4. 5. HOUSE RULES: GUEST and all members of the guest's party agree to abide by the House and Pool Rules attached as Exhibit A and the House Book Rules* at all times while at the property. Any violation of the House and Pool Rules will result in terminations of the agreement and GUEST will forfeit any unused rent and security deposit. 6. ACCESS: Guests shall allow Homeowner access to the property for purposes of repair and inspection. Homeowners shall exercise the right of access in a reasonable manner. The undersigned agrees to take responsibility for all guests' actions and behavior during the rental period, including informing all parties of the house and pool rules and pages guidelines noted in the document. HOUSE RULES 1. In addition to the House Rules under Exhibit A of this Rental Agreement, House Rules stated in the Sweetbriar Guesthouse House Book apply to this Agreement. 2. GUEST RESPONSIBILITY: The person signing this contract will be present during  the entire rental period and is at least 25 years of age (SUBLETTING IS  PROHIBITED AND WILL RESULT IN IMMEDIATE TERMINATION OF  AGREEMENT AND FORFEITURE OF DEPOSIT AND UNUSED RENT).   3. NO EVENTS of any kind are allowed on the property. Dwelling is a single family  house in a residential neighborhood and is NOT an event center. GUEST agrees NOT to have any type of event at the house, including (but not limited to) Corporate/Company meeting, Wedding, Bachelor/Bachelorette party, or any large gathering.   4. QUIET TIME: 9 PM until 9 AM is “quiet time” EVERY DAY. All noise including loud  talking and music and other sounds will be moved indoors during the hours  designated as “quiet time”.   5. GUEST BEHAVIOR: 1) GUEST agrees not to act in a loud, boisterous, unruly or thoughtless manner or disturb the rights of neighbors’ peace and quiet, or allow his/ her guests to do so; 2) to use the home only as a private residence, and not to  engage in any activity or allow any condition that is illegal or dangerous or which would cause a cancellation, restriction, or increase in premium in homeowner’s insurance or allow his/her guests to do so.   6. HOME USE/WEAR & TEAR: GUEST agrees not to damage or misuse the home and contents and/or allow his/her guests to do so. GUEST agrees that the home will be left in good condition at the end of rental period. GUEST shall pay for any repairs or replacement, all loss or damage to the house and its contents whenever such  damage or loss is beyond normal wear and tear.  7. IMMEDIATE DEFECTS: GUEST agrees to inform homeowner if there are any defects or  non-working issues with the home. This includes (but not limited to) any water leakage or other typical home maintenance issue that may cause substantial  damage to the home if not remedied immediately.   8. CANDLES, FIREWORKS, OPEN FLAME: Please do not use fireworks, or any open flame inside or anywhere on the property with the exception of and limited to inside the wood burning stove and fire pit. Please DO NOT leave lit candles unattended. 9. OVERNIGHT GUESTS: People other than those in the GUEST party set forth above are not permitted on the property.  10. FIRE PIT: Outdoor fire pit is not safe for children who are unsupervised. Please be cautious and always supervise your children near and around the fire pit. 11. ACCIDENTS/INJURIES: This home is privately owned; the owners are not  responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Homeowners are not responsible for the loss of personal  belongings or valuables of the GUEST and guests. By accepting this reservation, it is agreed that  all guests are expressly assuming the risk of any harm arising from their use of the  premises or others whom they invite to use the premise.   12. WATER DANGERS: GUEST acknowledges that this home has a bathtub and is next  to a pool. GUEST acknowledges that the homeowner is not responsible for any accidents or injuries arising from use of the bathtub or the pool. GUEST assumes all responsibility to ensure each renter and their guests are safe.  All children should be supervised both in the bathtub and pool area.   13. NO LIABILITY/INDEMNIFICATION/HOLD HARMLESS: The owners of the property do not assume liability for the loss, theft, damage or injury (or death) to persons or  their personal property. GUESTS agree to indemnify and hold the owners harmless for any liabilities, theft, damage, cost or expense whatsoever arising from or related to any claim or litigation which may arise out of or in connection with GUEST use and  occupancy of the rental property, including but not limited to claims for personal  injury or property damage/loss.   14. Only use appliances for their intended uses   15. DOGS are allowed but must be included in the initial booking. Dogs should be house-trained and well behaved. Animals should NEVER be left unattended in the guesthouse. No animals on beds, or in pool. Limit is 2 dogs. We charge a $50/pet cleaning fee per stay (this covers up to 2 pets). 16. No photo, video or film shoots of any kind on the property. 17.  While we want our guests to roam the property freely, we ask that they respect the areas around our private home and art studio. POOL RULES and POLICIES For your safety and protection, please read these rules and precautions prior to using the pool.  • Pool is open by Memorial weekend and closes sometime in September. Opening and closing dates are determined by the weather. • Please do not bring glass in or near the pool. That includes beer bottles and wine bottles etc. • No diving, running or horseplay. • Please do not use the pool under the influence of alcohol, narcotics, or if you are ill. • No animals allowed in the pool. • No lifeguard on duty, swim at your own risk. • We are not responsible for accidents or injuries. • Children under the age of 14 must be supervised at all times by an adult. Toddlers must wear a swim diaper. • Absolutely no electrical appliances should be used in or near the pool.   • Guest(s) agrees to leave the pool in the same condition it was received.
